Primary Law Arab Council for the Gifted and Talented (ACGT)

Definition of the Council:
It is an Arab educational, non-governmental and professional academy which enriches everything related to the field of talent and gitedness and their development.

Chapter 1

Name and Center Founders and Objectives:

Article (1):

This system is called the statute of the Arab Council for the Gifted and Talented.

Article (2):

The following words and phrases, wherever stated in this Law, shall have the meanings assigned to them hereunder, unless the context otherwise indicates: –

Ministry: Ministry of Culture in the Hashemite Kingdom of Jordan

Minister: Minister of Culture

Law: Bodies and Associations Law No. 33 of 1996, or any other law replacing it.

General Assembly: They are all registered members and payers for their annual contributions.

The Commission: The Administrative Board of the Arab Council for the Gifted and Talented established according to the provisions of this system.

Chairman: Chairman of the Board of Directors of the Arab Council for the Gifted and Talented.

Vice-President: Vice-Chairman of the Board, acting on behalf of the President in his absence, and shall enjoy all powers vested in the President under these Rules.

 Member: Everyone who meets the conditions of membership in this Council.

Founding Body: The group of founding persons mentioned in this Law.

Committee: Any committee formed by the Administrative Board to carry out certain tasks.

Secretary: A member of the administrative body, who prepares the meetings of the Council and records the minutes of meetings and decisions of the Administrative Board and carries out any duties and work entrusted to the Administrative Board.

Treasurer: A member of the Administrative Board responsible for financial affairs in accordance with the provisions of these regulations.

Article (3):

The following members are considered as founding members:

Article (4):

  1. The constituent body shall elect from among its members an Administrative Board for a period not exceeding one year from the date of adoption of the statutes of the Arab Council for the Gifted and Talented.
  2. It authorizes the Interim Administrative Board to accept membership applications, collect contributions and carry out the registration procedures of the Council with the concerned authorities in the host country.
  3. The interim Administrative Board of the Arab Council for the Gifted and Talented should invite the General Assembly to meet for the election of an administrative body in accordance with the provisions of this Law during the period mentioned in paragraph (a) of this article.
  4. Members of the constituent body shall be considered as members of the General Assembly.

 

Article (5):

  1. A system called the Arab Council for the Gifted and Talented shall be established under this Law and shall have a legal personality with financial and administrative independence. In this capacity, it shall be entitled to take all legal actions, including the conclusion of contracts, the right to own and borrow, accept donations and carry out judicial proceedings, and to appoint any lawyer or other agent for this purpose or otherwise.
  2. The Center of the Arab Council shall be in the city of Amman / Hashemite Kingdom of Jordan,

PO Box 2043, Jubaiha -11941 Jordan, Tel: + 962-6-5345387, Fax: + 5345362-6962, Mobile: + 972-7535336, and has the right to open branches within the Hashemite Kingdom of Jordan and in all Arab countries.

  1. With the approval of the members of the General Assembly, the center of the Council may be transferred to any other Arab city. It may also establish branches at the level of the represented Arab States.

 

Article (6): Objectives and Means:

The Arab Council for the Gifted and Talented aims to achieve the following goals and objectives:

  1. To strengthen the scientific and educational ties between the members of the Council from the Arab States and to create a common language in this important cultural field.
  2. Helping to raise interest in the field of talent, excellence and creativity.
  3. To contribute to the movement of scientific and educational culture and to disseminate knowledge in this field as widely as possible.
  4. Conduct research and theoretical and experimental studies that provide a better understanding of the concepts of this field.
  5. Contribute to the movement of publishing through the issuance of pamphlets and brochures, and work on the development of educational materials related to the field of talent and creativity and excellence.
  6. Issue a newsletter and a periodical.
  7. Holding periodic meetings in the form of seminars, workshops, conferences and training courses.
  8. Provide the facilities of databases, information and benefit from any technologies that help link academics and those interested in the field of talent and creativity in the Arab countries.
  9. To strengthen the relations of cooperation between the members of the Arab Council for the Gifted and Talented members of international associations and bodies of common interest.
  10. Establish professional relations with national institutions of public education and develop them to serve the educational development movement.
  11. Supporting educational programs and projects for the gifted and talented people in all possible forms.

 

 

 

 

Chapter 2

Membership

 Article (7): Terms of Membership:A person who may be a member of the Council shall be required to:A. Be interested in the field of gifted and talented students and their care.B. To submit a request in writing and approved by the Administrative Board.C. To pay the membership fees and the required contributions.The membership of the Arab Council for the Gifted and Talented is divided into three types:1. Membership of individuals is divided into three sections:a. Active member: Who has the right to vote and nominate.B. Associate Member: He has no right to vote and to be nominated.C. Student Member: Has no right to vote and nominate. 2. Membership of governmental and non-governmental institutions and bodies.3. Honor Membership.

 

Article (8):

The applications for membership shall be submitted in writing to the Aedministrative Board of the Council on the form prepared for this, together with the registration and subscription fees. In the light of the examination of the application and the verification of the conditions of membership. It will be accepted or rejected within a maximum period of three months from the date of submission of the application. The injured party shall have the right to appeal the decision of the Administrative Board by written request within a maximum period of two months from the date of notification of the decision or the expiration of the three-month period without a decision. The appeal shall be submitted to the General Assembly of the Council at its next regular meeting to take the appropriate decision.
Article (9):

Membership shall be terminated by a decision of the Administrative Board of the Council in case:

  1. Non-payment of contributions for two consecutive years.
  2. Resignation, withdrawal or death of the member, or violation of the membership conditions provided for in the bylaws and by-laws.

Article (10):  The rights of the member:1. The effective member shall be entitled to elect or run for election to the administrative board or to any of the committees in accordance with the provisions of this Law.2. To benefit from all the facilities and assistance granted by the Society to its members. Article (11): The member shall:1. Abide by the objectives and goals of the Council and to work towards achieving them.2. Abide by the provisions of this Law and all decisions issued by the Administrative Board.3. Pay all financial obligations within the time specified in this system.4. Inform the Administrative Board of his address and any change that may occur.

 

Chapter 3

General Assembly
Article (12):

  1. The General Assembly shall consist of all members who meet membership requirements.
    B. The General Assembly shall hold a regular meeting once every two years at the invitation of the Governing Body. The members shall be notified in writing of the date and place of the meeting at least two months in advance, together with the agenda.
  2. The General Assembly shall have the right to hold one or more extraordinary meetings during the year at the invitation of the Administrative Board or at the request of two thirds of the members of the General Assembly. The written invitation to its members shall include the issues to be discussed at the extraordinary meeting. In the event that the meeting is requested at the request of two-thirds of the members of the General Assembly of the Council, the Administrative Board shall convene the meeting within two months from the date of submission of the application.

D. The Administrative Board shall prepare a list of members who are entitled to attend the meeting of the General Assembly.E. No member shall be entitled to participate in a meeting of the General Assembly and to vote on its decisions unless he has paid all the financial obligations required of him.F. The meeting of the General Assembly shall be presided over by the President or his deputy, if the president was absent.G. The General Assembly shall take its decisions by an absolute majority of its members present.H. The Minister shall be notified in writing of the place of the meeting of the General Assembly and its date fifteen days from the date of its appointment, accompanied by the agenda and disclosure of the names of memberswho are entitled to attend the meeting of the General Assembly and the Minister may delegate a Ministry staff member to attend the meeting.

Chapter 4

 

Administrative Board
Article (13):
 The Administrative Board is the executive body of the Council for two years.Article (14): 1. All Arab countries represented in the General Assembly shall be represented by the Administrative Board. 2. The Administrative Board may include more than one member of the same country, provided that the number of its members does not exceed three members.3. Subject to the provisions of paragraph (2), the number of members of the administrative body shall be proportional to the size of the membership in each country (except the country of the headquarters) each 25 members or less in the General Assembly will be represented by a member of the Administrative Board. A second member shall be added if the number of participants is more than fifty, and a third member will be added if the number of participants exceeds 80 members. 4. The headquarters country of the Governing Body shall consist of the President, the Vice-President, the Secretary and the Treasurer, regardless of the size of the membership.Article (15): The functions of the members of the Administrative Board shall be as follows: A. The Chairman: He is the Chairman of the Council, the Chairman of the Administrative Board and its legal representative to others. The Chairman represents the various bodies, institutions, official, academic and popular bodies. He presides over the meetings of the Council. He delegates the Secretary of the Council to instruct the General Assembly to convene the meetings and he signs both the bonds together with the Treasurer and the membership cards.B. Vice President: He represents the President in case of his absence and carries out his duties throughout his absence and supervises any tasks assigned to him by the President and the Administrative Board.C. Secretary: 1. Keeps documents, records and stamps of the Council. 2. Organizes minutes of meetings organized by the Administrative Board the General Assembly. 3. Be responsible for the assets of the Board. 4. Calls for the meetings of the Administrative Board and meetings of the General Assembly mandated by the President. 5. Follows up the decisions issued by the Administrative Board and the General Assembly of the Council.

D. Cashier:1. Keeps financial records, accounts, bonds and banknotes. 2. Prepares financial reports submitted to the Administrative Board and the General Assembly. 3. Collects the fees and contributions from the members and the revenues of the activities of the Council. 4. Collects the contributions approved by the Administrative Board. 5. Arranges the exchange bonds and signs them with the President and fulfills the financial obligations of the Council. 6. Any other tasks assigned to the cashier by the General Assembly.E. Member:1. Attends the periodic meetings of the Administrative Board.2. Attracts new members to the Council.3. Explains the message of the Council and works on the implementation of its programs and decisions.4. Prepares for conferences and provides the Council Secretary with information on activities related to fostering talent and creativity in his country.    Chapter 5Rules of Procedure Article (16):The Administrative Board of the Council may cancel the membership permanently or freeze it for a period not exceeding five years in the following cases:1. If the Member has not paid the contributions due to the Council after the expiry of three months from the date of maturity and shall be notified in writing by registered letter sent to his address written at the Council at least one month from the date of the decision.

2. If he contravenes the statute of the Council, erodes its reputation or damages it financially, after being convicted by the Commission of Inquiry established by the administrative body of the Council for the consideration of these cases. Article (17): The Administrative Board of the Council shall notify the member of the decision to cancel or freeze the membership of the person concerned at his address registered with the Council within fifteen days from the date of issue of the decision.
Article (18): The appeal shall be submitted to the General Assembly at its next meeting within a maximum period of two months from the date of issuance of the decision and shall be recorded in the register of the incoming and presented to the General Assembly at its next meeting.

 

Article (19):  Re-membership:

  1. The Administrative Board may restore the membership of a member whose membership has been terminated due to default on payment of his financial obligations after payment of all outstanding obligations, including a new enrollment fee. The date of payment shall be the date of his new membership.
  2. Membership shall be confirmed at the end of the period of freezing in accordance with the decision of the administrative body of the Council, provided that the member submits an appeal for membership within a maximum period of fifteen days from the date specified for the expiry of the freeze.

Article (20):The General Assembly shall assume the following powers and functions at its ordinary meeting: 1. Discuss the annual report on the activities of the Council submitted by the Administrative Body on its work during the past two years and develop the general policy of the Council. 2. Review the auditor’s report, discuss the financial report and approve the final accounts of the Council for the past two years. 3. Adoption of the draft budget for the next two fiscal years.4. Election of the Administrative Board for the subsequent session. 5. Consideration of any topics proposed by members of the General Assembly of the Council in the invitation to the meeting. 6. Consideration of any topics proposed by the members of the General Assembly of the Council, which shall be submitted to the Administrative Board in writing at least one month before the meeting.
Article (21)
The draft resolutions shall be voted by show of hands and any member may propose that the decisions be taken by secret ballot, subject to the absolute majority approval of such ballot.
Article (22): After the General Assembly discusses the administrative and financial reports, and upon the expiration of the term of the Administrative Board of the council, the president shall submit the resignation of the Administrative Board. The general assembly shall elect a committee of three members, one of whom shall be the chairman of the session. After the election of the Administrative Board and the counting of votes, the new Administrative Board shall conduct the session duly and in the presence of the representative of the ministry.

 

Article (23):

The Chairman and / or the members of the Administrative Board may be elected by acclamation on the proposal of one of the members of the General Assembly and on the recommendation of three members and the approval of an absolute majority by the show of hands. Three candidates shall be appointed as candidates. A person who nominates himself as a member of the Administrative Board shall be required to:

  1. Be an active member of the General Assembly of the Council. His membership should have been valid for at least one year.
  2. Have paid all its financial obligations at least one month prior to the meeting of the General Assembly of the Council.
  3. In addition to the above, a person who has been nominated for the post of President shall be required to have attained full membership for at least two years or to be one of the founders.

Article (24):

  1. The president and the members of the Administrative Board shall be elected simultaneously under two different forms of election cards, one for the election of the president and one for the election of members of the Administrative Board. The cards shall be stamped by the board and signed by the chairman of the election supervision committee and the representative of the ministry.
  2. Two special funds shall be allocated for the establishment of the special card for the election of the President and the second for the establishment of the card for the election of the members of the Administrative Board.

Article (25):

  1. The ballot papers shall be delivered to the member who is entitled to vote under the list of names of the members.
  2. The votes shall be publicly counted by the Committee provided for in Article 22 of this Law.
  3. In the case of equal votes between candidates, the winner shall be chosen by lot by the committee supervising the elections.

Article (26):

  1. The Chairman of the Administrative Board, or Vice-Chairman if the chairman was absent, will lead the meeting. Decisions shall be taken by majority. In the event of a tie, the vote shall be voted on by the President. The minutes shall be recorded by the Secretary of the Council and signed by the President, the Secretary of the Council and the members present.
  2. The Administrative Board shall meet at least once every six months for a regular meeting. The Authority may grant some members a written authorization to submit proposals and research presented on the agenda if they can not attend for any reason.
  3. Membership shall be waived from the member of the Administrative Board if he is absent from two consecutive meetings without an acceptable excuse.
  4. In the case of resignation or termination of membership from any member of the Administrative Board, the next member shall be replaced by the reserve votes as a result of the ballot according to which the members of the Administrative Board were elected. If there are no reserve members, the Administrative Board shall have the right to call the General Assembly for an emergency meeting in which the members of the Administrative Board shall be completed if necessary.
  5. The Administrative Board shall be considered resigned if more than half of its members resign and the General Assembly of the Council shall be invited to an emergency meeting to elect a new Administrative Board within a maximum period of three months from the date of resignation supplementing more than half of the members.

Chapter 6

Financial Provisions

Article (27)

The financial year of the Arab Council for the Gifted and Talented begins on the first day of January and ends on the 31st day of December of the same year.
Article (28)

The financial resources of the Arab Council for the Gifted and Talented are composed of the following sources:

  1. Subsription fees and annual membership fees.
  2. Gifts and donations received by the Council and approved by the Administrative Board.
  3. Income from the activities of the Council.
  4. Any other revenues that do not conflict with the objectives, orientations and goals of the Council.

Article (29):

  1. The subscription fee for individuals is US $ 10 and is paid once upon application.
  2. Membership fee for individuals with a minimum of US $ 100 for an active member for two years. Subscription fee for institutions, for a minimum of US $ 200, for two years.
  3. The subscription or membership fee shall be modified with the approval of the majority of the General Assembly.
  4. Students are exempted from subscription fees and their membership fees are reduced by 50%.

Article (30):

  1. The funds of the Arab Council for the Gifted and Talented shall be deposited with a bank designated by the Administrative Board.
  2. The Treasurer may not keep in the treasury of the Board more than five hundred dollars in cash, in the form of a permanent advance payment in case of emergency.
  3. No amount may be withdrawn from the funds of the Board at the designated bank unless the President of the Council, or the Vice-President in the president’s absence, and the Treasurer have signed the check together.

Article (31):

The Treasurer shall submit monthly reports on the accounts of the Board to the Administrative Board and shall be accountable to the Administrative Board for financial matters within the limits of his powers.
Article (32):

Administrative Board shall appoint a legal auditor who shall audit the accounts of the Board and shall approve the annual financial report submitted to the General Assembly by the Administrative Board.

Chapter 7

Transitional Provisions

 

Article (33):The Council has the right to own and lease property, land and other movable and immovable property and has the right to sell, pledge or lease any of them by a decision taken by the Administrative Board with the approval of the General Assembly.

Article (34)

The General Assembly is the only authority empowered and entitled to make any amendment to the Statute by a two-thirds majority of the votes in a regular or emergency meeting convened by the Administrative Board. Topics other than the subject of the amendment may be discussed.
Article (35):

The Council will be dissolved by a written decision taken by the General Assembly at an extraordinary meeting, provided that the number of votes in favor of the decision to disband the Council shall not be less than four fifths of the members of the Council.
Article (36):

In the case of dissolution of the Council, all of its movable and immovable property shall be transferred to the body determined by the General Assembly and with the approval of the Minister.

Article (37):

An appropriate remuneration or monthly salary shall be paid to those who are required to carry out the activities of the Council and to those who will carry out specific tasks within the limits of the decision of the Administrative Board.

Article (38):

If any member of the Administrative Board is assigned to any administrative work or task outside the headquarters of the Council, he shall be given the financial reward and travel allowances determined by the Administrative Board, provided that no party has paid the money and travel expenses.
Article (39):

The General Administrative Board shall issue the internal rules and regulations to implement the provisions of the Statute in order to ensure the proper functioning of the work, provided that these instructions and regulations do not contradict the provisions of this Law.
